In Regulatory Notice 24-09, FINRA reminded member firms that its rules apply when they use generative AI, and noted that the content standards of Rule 2210 apply whether a communication is generated by a human or a technology tool. Supervision requirements apply as well.

Consumer financial products: no unfair, deceptive, or abusive practices

Federal law makes it unlawful for providers of consumer financial products and services to engage in unfair, deceptive, or abusive acts or practices. An ad can include correct disclosures and still mislead if other statements in it are untrue or leave out something material. Check each claim against the actual product terms.

The SEC's Marketing Rule governs advertisements by investment advisers, including testimonials, endorsements, and performance. Do not let an AI draft performance figures, client results, or testimonials. Have compliance approve any such content and keep the records the rule requires.
