Email has legal and technical rules, especially when it is marketing. These are the main points to know before you send.

Marketing emails must follow CAN-SPAM

The CAN-SPAM Act requires accurate header information, subject lines that do not deceive, a clear identification of the message as an ad, your valid physical postal address, and a clear way to opt out. You must honor opt-out requests within 10 business days, and penalties can reach $53,088 per email. AI drafts will not add these, so add them yourself.

Gmail has sender requirements

Google's guidelines say that marketing and subscribed messages sent to Gmail accounts must support one-click unsubscribe and include a clearly visible unsubscribe link, and that senders must set up email authentication such as SPF or DKIM. If you send more than 5,000 messages a day to Gmail accounts, stricter requirements apply, including DMARC.

Do not deceive recipients

A draft can sound more familiar, urgent, or personal than is true, for example by implying a relationship or inventing a deadline. Keep subject lines accurate, do not pretend to be someone else, and avoid false urgency. Deceptive email damages trust and can be illegal.

Keep other people's confidential emails out of prompts

Before you paste an email thread into an AI tool, think about what it contains. Client details, personal information, and anything covered by an agreement may not be yours to share. Remove names and sensitive details, or write the reply from a summary.

Check facts, names, and promises

AI will fill gaps with plausible text. Make sure the names, dates, amounts, and commitments in the email are right, and never let a draft promise something you cannot deliver. Read it out loud once before you send.
